By accessing or using the website at sanleandroasphaltpaving.com, requesting a quote, or engaging San Leandro Asphalt Paving ("Company," "we," "us," or "our") for any services, you agree to be bound by these Terms and Conditions. If you do not agree, do not use our website or services. These terms apply to all visitors, customers, and others who interact with our website or engage our services.
San Leandro Asphalt Paving provides asphalt paving, sealcoating, parking lot striping, driveway paving, pothole repair, crack sealing, resurfacing, grading, concrete work, and related exterior contractor services in San Leandro, California and the surrounding East Bay communities.
All services are subject to a written agreement or work order between the Company and the customer prior to commencement of work. Website content, including service descriptions and general guidance, is provided for informational purposes only and does not constitute a binding offer or guarantee of specific outcomes.
Written estimates are provided based on the conditions observed at the time of the on-site assessment. Estimates are valid for 30 days from the date issued unless otherwise noted in writing.
Final pricing may be adjusted if site conditions discovered during the work differ materially from those observed during the estimate - for example, if subsurface base damage is found that was not visible during the initial walkthrough. We will notify you before proceeding with any work that would increase the quoted price.
No work begins without written authorization from the customer. An estimate alone does not constitute a contract.
Jobs are scheduled based on crew availability and weather conditions. We reserve the right to reschedule work if weather conditions are unsuitable for the type of service being performed (for example, wet or cold conditions that would prevent proper asphalt curing). We will notify you as soon as possible if a rescheduling is necessary.
If you need to cancel or reschedule, please notify us at least 48 hours before the scheduled job date. Cancellations with less than 48 hours notice may result in a cancellation fee to cover mobilization costs already incurred, as specified in your written work agreement.
Deposits, if required, are non-refundable once materials have been ordered or crew time has been committed to your project, unless we cancel the job.
Payment terms are specified in the written work agreement provided before work begins. Unless otherwise agreed in writing, payment is due upon completion of the work. For larger commercial projects, a deposit and progress billing schedule may apply as described in the project agreement.
Accepted payment methods will be specified in your work agreement. Invoices not paid within the agreed timeframe may be subject to a late payment fee and may result in the matter being referred to a collection agency or legal proceedings to recover the outstanding balance.
The customer is responsible for all costs of collection, including reasonable legal fees, if payment is not received by the due date.
The customer is responsible for:
We are not responsible for delays or damage resulting from the customer failing to meet these responsibilities.
Any warranty applicable to a specific project will be stated in the written work agreement. In the absence of a written warranty, services are provided as-is. General warranty terms, where offered, cover workmanship defects and do not cover:
The website content and general service information are provided "as is" without warranties of any kind, express or implied. We do not warrant that the website will be error-free or continuously available.
To the fullest extent permitted by applicable law, San Leandro Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or website, including but not limited to loss of income, loss of use, or property damage not directly caused by our negligence.
Our total liability for any claim arising from a specific project shall not exceed the amount paid by the customer for that project. Some jurisdictions do not allow limitations on liability for certain types of damages, so these limitations may not apply to you in full.
If a dispute arises between you and San Leandro Asphalt Paving regarding our services or these terms, we ask that you first contact us directly to try to resolve the matter informally. Most issues can be resolved quickly with a direct conversation.
If informal resolution is not possible, the parties agree to attempt mediation before initiating any formal legal proceedings. If mediation does not resolve the dispute, either party may pursue available legal remedies in the courts of California.
These Terms and Conditions and any disputes arising from them are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings arising from these terms shall be brought in the appropriate courts located in California.
